Kenya is now a signatory to both the CbC MCAA and the Multilateral Convention on Mutual Administrative Assistance in tax matters.

Multilateral competent authority agreement signed

Kenya signed the multilateral competent authority agreement (MCAA) on the exchange of country-by-country (CbC) reports on 9 September 2022.

Kenya is now a signatory to both the CbC MCAA and the Multilateral Convention on Mutual Administrative Assistance in tax matters, which will enable the automatic exchange of financial information in tax matters between Kenya and the other signatory members. In addition, non-resident multinational enterprises (MNEs) that file a CbC report in another jurisdiction that is also a signatory will not be required to file in Kenya, but will only have to notify the Kenya tax authority of the entity that is responsible for the filing obligation.

Kenya enacted CbC reporting rules for multinational groups with turnover greater than KES 95B (approximately €750 million) in the Finance Act 2022.
