An updated version of the guidance notice regarding the marketing of units of EU UCITS

Following the transposition of EU Directive 2019/1160 into German law, the Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) in August 2021, issued an updated version of the guidance notice regarding the marketing of units of EU “Undertakings for the Collective Investment in Transferable Securities” (UCITS).

The main changes in the new version of the guidance notice pertain to the following:

  • Notification letter
  • Requirements for marketing
  • Discontinuation of marketing in Germany
