Mexico: Teleworking measures amending the labor law

Mexico’s Congress on 9 December 2020 approved measures to amend the labor law regarding teleworking.

The measures define “teleworking” as the performance of paid activities in a place other than the employer's workplace on a regular basis, and therefore that the physical presence of the worker at the workplace is not required. For the teleworking provisions to apply, more than 40% of the labor activity must take place in the domicile or at another indicated place.

There are contractual requirements, such as the working conditions must be established in writing and must contain information such as the nature and characteristics of the work; the equipment and work supplies, including that related to occupational health and safety obligations for teleworkers; a description and amount that the employer will pay to the worker for conducting work at home; and the supervision, duration, and distribution of work schedules.
