We refer to our update statement of 30 May 2018. This update concerns the appeal filed by Attestor at the Court of Appeal appealing Hildyard J’s first instance judgment handed down on 25 May 2018 (the “Judgment”) in respect of the application issued by the Joint Special Administrators and Joint Supervisors on 22 March 2018 seeking directions from the Court regarding the implementation of the CVA (the “CVA Directions Application”). Please find here a copy of the CVA Directions Application notice and a copy here of the sealed order for your information. Please refer to our update of 30 May 2018 for a summary of the Judgment.
We confirm that a one-day hearing for the appeal has been scheduled before the Court of Appeal for 6 June 2018 at the Royal Courts of Justice located on the Strand. Please refer to the court’s listings (when available) for further details as to the exact venue and timing for the hearing.
Given that Attestor has appealed the Judgment, the Special Administrators have agreed not to provide the confirmation required under clause 3.1(e) of Section 2 of the CVA until after 12pm on 11 June 2018.
