In an opinion piece, Kasturi Nathan, KPMG Head of Governance and Sustainability in Malaysia and Krishman Varges, Manager at the KPMG Management and Risk Consulting Sdn Bhd, wrote that Malaysia’s image among global opinion shapers is rising with corporate chiefs now responsible in ensuring clean management at all levels.
They shared that it no longer takes two to tango when it comes to prosecution of corruption offences as the dance floor is now wider and merrier, thanks to the corporate liability provision which was enacted in May 2018 vide the Malaysian Anti-Corruption Commission (Amendment) Act 2018.
Aside from the recipient and giver of gratification there are other parties who will be mad culpable for their inaction and failure to prevent nefarious behavior. Simply put, docility will be regarded as complicity.
