As announced under the National Economic Recovery Plan on 5 June 2020, the special tax deduction granted to building owners who provide a rental reduction of at least 30% to their Small and Medium Enterprise (“SME”) tenants has been extended for another 3 months up to September 2020. 

The Malaysian Inland Revenue Board (“MIRB”) has issued an updated Frequently Asked Questions (“FAQs”) dated 15 June 2020 on its official website in respect of this extended tax incentive.  Apart from incorporating the 3-month extension for the incentive, the FAQs were also updated to include supporting documents which are required to be kept by taxpayers who wish to claim the special deduction, namely:

  • SME Status Certificate issued by SME Corporation Malaysia to SME tenants.  This certificate would be relied upon for the purposes of verifying the SME status of the tenant and as such, it appears that the conditions previously imposed by the MIRB in relation to the cut-off date used in determining the SME criteria of the tenant no longer apply; and  
  • Worksheet (HK) which requests details concerning the tenant, rental and rental reduction methods.
