Decreased rate of the statutory penalty interest

The Government of the Republic of North Macedonia has adopted a Decree with force of law amending the calculation of the statutory penalty interests rates as follows:

  • The penalty interest rate shall be determined on a monthly basis instead of twice a year by using as the reference for calculation the latest reference rate published by the National Bank of the Republic of North Macedonia.
  • The penalty interest rate in agreements concluded between trading companies or public entities shall be calculated as the reference rate increased with 5%.
  • The penalty interest rate in contracts to which at least one party is other than a trading company, shall be calculated as the reference rate increased with 4 %. This new penalty interest rate shall be applicable to contracts concluded 2 April 2020 onwards.

The decrease of the interest rate is applicable as of 3 April 2020 and shall remain in force until its revocation is published by the Government.

Mandatory use of the annual paid leave by the employees

The Decree was published in the Official Gazette of the Republic of North Macedonia no. 90/2020 dated 4 April 2020 regulating the application of the Law on Labour Relations during state of emergency.

Upon employer's approval and taking into consideration the workflow's requirements, the employees in the most affected businesses in the private sector shall use:

  • The outstanding annual paid leave for 2019 by 31 May 2020;
  • Two consecutive working weeks from the annual paid leave for 2020 by 30 June 2020.

Approved leave due to pregnancy, childbirth and parenting/adoption that come to end shall be prolonged and social security compensation shall be paid until the expiration of the temporary preventive measures.
