Join our webcast: CJEU Danish cases: game changer for intermediary holding companies?

On 26 February 2019, the Court of Justice of the European Union (CJEU) issued several decisions that interpreted the concept of "beneficial owner" (C-115/16 to C-119/16 and C-299/16) for the Parent-Subsidiary Directive (PSD) and the Interest and Royalties Directive (IRD).

These cases involve Danish companies owned by other Luxembourg or Swedish intermediary holding companies, the latter being entirely controlled by non-EU investment funds either directly or indirectly. The CJEU denied the application of PSD and IRD to EU-parent companies, stating they were not the payment’s beneficial owners.
