Argentina–Nat'l Immi Ofe Extends Residency Deadline
The Argentinean National Immigration office has again extended some deadlines for individuals with expiring transitory and temporary residencies in Argentina, and also for companies needing to renew their inscription at the National Immigration office.
Highlights
The Argentine National Immigration office (Dirección National de Migraciones) announced on 15 May, Provision N° 2205/2020 extending for 30 days the deadlines announced in Provisions N° 1714/2020 and 1923/2020, for individuals with transitory and temporary residencies in Argentina, and also for companies that need to renew their registration at the National Immigration office.1 (For prior residency extension coverage, see GMS Flash Alert 2020-136 (1 April 2020).)
This new provision aims to protect the Argentine population and control and prevent the further spread of COVID-19. (For prior coverage of the mandatory quarantine, see GMS Flash Alert 2020-131 (30 March 2020).)
WHY THIS MATTERS
The new steps provide additional support to foreign individuals who need to extend their transitory or temporary residencies, bringing relief for those individuals whose residence status in Argentina may otherwise expire and who cannot go personally to the National Immigration Office, which remains closed until 24 May.
Additionally, the actions allow companies extra time to renew registration.
Context
The rapid worldwide spread of the novel coronavirus (COVID-19) has underpinned the National Immigration office’s decisions, with the aim of bringing some certainty to individuals who need to extend their stay in Argentina, while also taking actions to address the COVID-19 pandemic.
New Provision
Provision 2205/2020 (extending measures in Provisions 1714/2020 and 1923/2020) contains the following measures to bring some relief to individuals residing and companies doing business in Argentina:
1. Extending the validity of the individual’s residence status granted under Article 23 (temporary residence) and Article 24 (transitory residences) of Law 25.871 for thirty (30) days from their normal expiration date;
2. Extending the validity of the Residence Precaria (Certificado de Residencia Precaria, a three-month interim residence certificate while application for temporary or permanent residence is being processed) granted in the framework of Article 20 (residence applications);
3. Extending the validity of the registration of the local company at the National Immigration Office for thirty (30) days as of the expiry date (17 May 2020);
4. Suspending the deadlines for compliance with any notice or summons emanating from ongoing proceedings for thirty (30) days from 17 May 2020.
KPMG NOTE
The National Immigration office closure period might be extended if the Argentine government decides to move forward with another 15-day-period extension of the existing mandatory quarantine after 24 May.
