Argentina – NIO Extends Residency Deadline
Argentina’s National Immigration office announced on 17 April, new rules extending for 30 days certain deadlines previously announced in Provision N° 1714/2020. The new rules provide further support for foreign individuals who, due to the COVID-19 crisis, need to extend their transitory or temporary residencies; for instance they provide for the extension of the validity of the individual’s residence status. The new rules also deal with registration of local companies at the National Immigration office.
The Argentine National Immigration office (Dirección National de Migraciones) announced on 17 April, Provision N° 1923/20201 (“new Provision”) extending for 30 days certain deadlines previously announced in Provision N° 1714/20202, that have to do with the automatic extension of transitory and temporary residencies in Argentina. There were also deadlines for companies with respect to renewal of their registration at the National Immigration office.1
The new Provision aims to protect the Argentine population and control and prevent the further spread of COVID-19. (For prior coverage, see GMS Flash Alert 2020-131 (30 March 2020).)
WHY THIS MATTERS
The new Provision provides further support for foreign individuals who, due to the COVID-19 crisis, need to extend their transitory or temporary residency. This should bring significant relief for individuals whose residence status in Argentina will soon expire and who cannot personally go to the National Immigration office, which remains closed until 26 April.
This will have considerable impact on how foreign individuals manage their personal situations concerning their right to stay in Argentina given the significantly different procedures around proper documentation and staying in Argentina.
These changes may also encourage employers to re-consider their personnel and work arrangements due to the new situation.
Context
The rapid worldwide spread of the novel coronavirus (COVID-19) has underpinned the National Immigration office’s decisions, as it adjusts its policies and processes in light of the health emergency to help bring some certainty to individuals who need to extend their stay in Argentina.
New Provision
Provision 1923/2020 (extending of the measures in Provision 1714/2020) contains the following measures:
- Extending the validity of the individual’s residence status granted under Article 23 (temporary residence) and Article 24 (transitory residences) of Law 25.871 for thirty (30) days from their normal expiration date;
- Extending the validity of the “Residence Precaria” (Certificado de Residencia Precaria, a three-month interim residence certificate while application for temporary or permanent residence is being processed) granted according to the framework of Article 20 (residence applications);
- Extending the validity of the registration of the local company at the National Immigration office for thirty (30) days as of the expiry date (as of 17 April 2020);
- Suspending the deadlines for compliance with any notice or summons emanating from ongoing proceedings for thirty (30) days as of 17 April 2020.
KPMG NOTE
The National Immigration office closure period might be extended if Argentina’s government decides to move forward with another 15-day-period extension of the existing mandatory quarantine after it ends on 26 April.
