The Foreign Contribution (Regulation) Act, 2010 (‘FCRA’) has undergone transformational changes over the recent past, with the objective to bring in more transparency and accountability with respect to utilisation of Foreign Contributions in India.

Stringent measures have been undertaken by the Ministry of Home Affairs (‘MHA’) against FCRA registered charitable organisations and their foreign donors for defaults made under FCRA. Recently, many FCRA registered NGOs have been subject to rigorous audit by the MHA. Coupled with it, significant amendments have also been introduced under the Income-tax Act, 1961, to further streamline the governing framework for charitable organisations.

These measures undertaken by the government make it imperative for charitable organisations to be fully compliant with all the applicable statutes and ensure strong documentation at all times, to keep their tax exemption status, FCRA license intact and mitigate the risk of penal consequences.
