New Law on Protection of Whistleblowers – Are you ready
On 1 July 2019, the Law on Protection of Whistleblowers came into force establishing the legal framework for the whistleblower regime and protection for whistleblowers.
The Law requires all employers employing more than 50 employees to implement internal whistleblower policies and to appoint a trustworthy person responsible for receiving and examining whistle-blowers’ objections and his deputy.
What steps should you take?
In preparation for the new law, you should take the following steps:
- By 1 January 2020 adopt a written internal whistle-blower policy;
- By 1 April 2020 appoint a trustworthy person as well as the deputy of such person.
A failure to implement internal whistleblower policies within the prescribed deadlines, could result in fines ranging between HRK 10,000 and HRK 30,000 for legal entities, and fines between HRK 1,000 and HRK 10,000 for their responsible persons.
