Izmjene  Zakona o strancima
 
Dana 22. srpnja   2017. godine stupio je na snagu Zakon o izmjenama i dopunama Zakona o  strancima, objavljen u Narodnim novinama br. 69/17.
 
Izmjene Zakona o   strancima izvršene su radi usklađivanja sa sljedećim EU direktivama:
 
1.  Direktivom 2014/67/EU – Raspoređeni radnici
 
Pored dosadašnje obveze poslodavca s poslovnim nastanom u drugoj državi članici EGP-a da za raspoređene radnike prije početka upućivanja na rad u Republiku Hrvatsku podnese izjavu o upućivanju Inspektoratu rada, strani poslodavac je sada u izjavi o upućivanju dužan ovlastiti i imenovati osobu koja će tijekom razdoblja upućivanja na mjestu rada ili na drugom jasno određenom i dostupnom mjestu u Republici Hrvatskoj u papirnatom ili elektroničkom obliku čuvati te na zahtjev nadležnog tijela dati na uvid:
 
-        preslike ugovora o radu raspoređenog radnika,
-        radnu dozvolu ili drugi akt kojim se dokazuje da je raspoređeni radnik državljanin treće zemlje zakonito zaposlen,
-        obračun plaće iz kojeg su vidljivi svi elementi i način utvrđivanja iznosa plaće,
-        dokaz o isplati plaće,
-        evidenciju radnog vremena iz koje je vidljiv početak, trajanje i završetak radnog vremena te
-        sve ostale dokaze koji su hrvatskim  tijelima potrebni za kontrolu i nadzor.
 
Strani poslodavac  je dužan čuvati navedene dokumente tijekom pet godina nakon završetka upućivanja.
 
Osim toga, strani  poslodavac s poslovnim nastanom u drugoj državi članici EGP-a je u izjavi o upućivanju  dužan imenovati osobu za kontakt u Republici Hrvatskoj koja će za vrijeme  upućivanja biti ovlaštena u ime i za račun poslodavca surađivati s nadležnim  tijelima te po potrebi primati i slati dokumente, zahtjeve, obavijesti i ostala pismena.
 
Sadržaj izjave o upućivanju bit će propisan pravilnikom koji bi se trebao donijeti do 22. kolovoza 2017. godine.
 
U slučaju da strani poslodavac ne podnese izjavu o upućivanju prije početka upućivanja ili u njoj ne imenuje osobe koje je dužan imenovati, može se kazniti za prekršaj  novčanom kaznom u iznosu do 50.000 kuna, dok iznos kazne za odgovornu osobu stranog poslodavca može doseći 10.000 kuna.
 
Jednaka novčana kazna može se izreći i primatelju usluge u Hrvatskoj ako je znao ili je mogao znati da koristi rad upućenog radnika koji nije zakonito zaposlen kod stranog poslodavca.
 
2.  Direktivom 2014/66/EU – Osobe premještene unutar društava
 
Pored dosadašnjih osnova za izdavanje dozvole za boravak i rad državljanima trećih zemalja,  ovim su izmjenama Zakona o strancima utvrđeni uvjeti za izdavanje dozvole za  boravak i rad državljanima trećih zemalja (rukovoditeljima, stručnjacima i  pripravnicima) koje njihov poslodavac sa sjedištem u trećoj zemlji privremeno  premješta u trgovačko društvo, podružnicu ili predstavništvo u Republici  Hrvatskoj koje pripada istoj skupini trgovačkih društava. Također se reguliraju uvjeti za njihov boravak i rad u Republici Hrvatskoj u slučajevima kada je dozvolu u svrhu premještaja izdala druga država članica EGP-a.   

  3.  Direktiva 2014/36/EU  –  Sezonski radnici
 
Izmjenama Zakona o  strancima također su propisani uvjeti za ulazak i boravak državljana trećih  zemalja u svrhu zapošljavanja u statusu sezonskih radnika te se utvrđuju  prava sezonskih radnika.

The amendments to the Croatian Law  on Foreigners
 
On 22 July 2017, the Law on Amendments to the Croatian Law on Foreigners, which was published in the Official Gazette No. 69/17, came into effect.
 
The amendments to the Law on Foreigners were primarily made with a view of implementing the following EU directives into the Croatian legal system:
 
1. The Directive 2014/67/EU – Posted workers
 
In addition to the earlier obligation of an EEA employer to submit a posting declaration  to the Labour Inspectorate prior to posting its workers in Croatia, EEA  employers will now also have to designate a person who will keep certain
documents at the place where the posted workers will work (or at another
specifically indicated place in Croatia). Specifically, this person will be
required to provide the following documents to the Croatian authorities
upon their request:
 
-        copies of Employment Contracts of posted workers,
-        work permit or another document proving that a posted worker who is a third country national is validly employed with his/her EEA employer that is posting the worker,
-        calculation of salary of the posted worker showing all salary elements and the manner in which the salary has been determined,
-        proof of payment of salary,
-        records on working hours showing commencement, duration and end of the posted worker’s working hours, as well as
-        all other documents that may be required by the Croatian authorities to exercise their power.

These documents have to be retained for the period of five years after the posting ends.      

EEA employers that are posting workers in Croatia will also have to appoint a person in Croatia who will act as the contact person for the Croatian authorities with a view of exchanging documents, requests, notices and other letters.
 
The form of posting declaration is to be determined by the By-law which is to be rendered by the Croatian Minister of Labour by 22 August 2017.
 
A failure to submit the posting declaration prior to the commencement of posting, or a failure to appoint the above persons can result in fines of up to HRK 50,000 for the foreign employer, and in fines up to HRK 10,000 for its
responsible person.
 
The same fines are prescribed also for the Croatian service recipient who knew or ought to have known that a posted worker engaged to provide services is not validly employed by a foreign employer. 
     
2. Directive 2014/66/EU – Intra-corporate transfers
    
In addition to the existing grounds for obtaining Work and Stay Permits for third country nationals, the amendments to the Law of Foreigners have added an additional ground for obtaining Work and Stay Permit by prescribing the requirements for issuance of Work and Stay Permits to third country nationals (i.e. managers, specialists and trainees) who are temporarily transferred by
their third country employers to a Croatian company, branch office or a
representative office belonging to the same group of companies as their
foreign employer. The amendments also regulate the immigration status of
such assignees in cases where the permit for their transfer has already
been issued by another EEA state.
 
3. Directive 2014/36/EU – Seasonal workers
 
The amendments to the Law on Foreigners also set out the conditions of entry and stay of third-country nationals for the purpose of their employment as seasonal workers in Croatia, as well as their rights during their stay and work in Croatia.
