Announcement on Imposing Additional Tariffs on Certain Imported Goods Originating in the U.S. (Second Batch) (Customs Tariff Commission of the State Council [2018]No.6)
On July 11, 2018, the U.S. government issued measures to impose tariffs on imports of goods worth approximately USD200 billion imported from China, and solicited public opinions on the said measures. On August 2, the U.S. side announced that it would increase the tariff rate imposed on the above-mentioned goods worth USD200 billion to 25% from 10%. In response, the Customs Tariff Commission of the State Council announced on August 3, 2018 to impose tariffs on 5,207 tax items of goods imported from the U.S., adding 25%, 20%, 10% and 5% tariff respectively, which involves a total import trade volume of approximately USD60 billion from the U.S. The effective date will be announced separately.
Announcement on Imposing Additional Tariffs on Certain Imported Goods Worth approximately USD 16 billion Originating in the U.S. (Customs Tariff Commission of the State Council [2018]No.7)
On August 8, 2018, in response to the second batch of tariff increase imposed by the U. S., the Customs Tariff Commission of the State Council announced the details of the list of goods imported from U.S., and decided to add 25% tariff on the items in the list from 12:01 on August 23, 2018.
Announcement on Relevant Matters Concerning the Supervision of Processing Trade (GAC Announcement [2018] No.104)
On May 29, 2018, the General Administration of Customs issued the Decision on the Abolition and Revision of Certain Rules to amend the relevant provisions under the Measures of the People’s Republic of China Customs on Supervision of Processing Trade Goods. In view of this, the General Administration of Customs reissued an announcement regarding relevant contents on August 13, 2018. The new contents include: relevant provisions concerning mortgage procedures, deep processing transit, outsourced processing, internal materials exchange, terminologies, etc.; Announcement [2005] No. 9, [2010] No. 93, [2014] No.21 of the General Administration of Customs shall be repealed simultaneously.
Announcement on Relevant Matters Concerning the Issuance of the Certificate of Origin of China and the Kimberley Process Certificate(GAC Announcement [2018] No.106)
Given that the former entry-exit inspection and quarantine management responsibilities and the corresponding team have been assigned to the General Administration of Customs, which issued an announcement on August 17, 2018. The management authority for the Certificate of Origin of China and Kimberley Process Certificate has been changed from the former General Administration of Quality Supervision, Inspection and Quarantine to the General Administration of Customs; the local entry-exit inspection and quarantine authorities of the authentication institution have been changed to the respective customs, which will officially launch a new version of certificate and stamp since August 20, 2018. The previous certificates issued by the former inspection and quarantine authorities shall remain valid until August 20. The various certificates of origin issued by the China Council for the Promotion of International Trade and its local branches shall also remain valid.
Announcement on Implementing Zero-tariff Treatment for 9% Tariff Items to Commodities originating in Burkina Faso(Announcement [2018] No.108 of the General Administration of Customs)
On August 22, 2018, the General Administration of Customs issued an announcement to implement special preferential tariff treatment (i.e. zero-tariff) on least developed countries for imported goods originating in Burkina Faso. With effect from September 1, 2018, zero- tariff rate shall apply to 97% tariff items originating in Burkina Faso. The consignee or its agent of the imported goods shall complete the Customs Declaration Form pursuant to regulations and submit the relevant documentation to the Customs.
Announcement on Internet plus Appointment Customs Clearance (Announcement [2018] No.109 of the General Administration of Customs)
In order to provide more convenient customs clearance services, the General Administration of Customs issued an announcement on August 22, 2018 to implement the internet model of “Appointment Customs Clearance”, it stipulates the applicable circumstances, operation methods and cancellation of appointments. The announcement will be effective from October 30, 2018.
Announcement on the Final Order of Anti-dumping Investigation on the Imported Halogenated Butyl Rubber originating in the U. S., the European Union and Singapore (MOC Announcement [2018] No.40)
The Ministry of Commerce issued an announcement on August 10, 2018, ruling that there is existence of dumping in respect of the imported halogenated butyl rubber originating in the U.S., the European Union and Singapore. Therefore, the Tariff Policy Committee of the State Council decided to levy anti-dumping duty for the imported halogenated butyl rubber originating in the U.S., the European Union and Singapore, with tariff rate ranging from 75.5% to 23.1% and an implementation period of 5 years.
Announcement on the Final Re-examination Investigation on the Anti-dumping Measures of the Imported BPA originating in Japan, South Korea, Singapore and the Region of Taiwan (MOC Announcement [2018] No.60)
On August 29, 2018,the Ministry of Commerce issued an announcement and determined to implement the final re-examination investigation on the anti-dumping measures applicable to the imported BPA originating in Japan, South Korea, Singapore and the region of Taiwan from August 30, 2018 to August 29, 2019. During this re-examination period, the imported BPA originating in the above areas shall continue to be subject to anti-dumping duty.
Release of Guide to Customs Valuation and Transfer Pricing (2018 Edition)
Recently, the World Customs Organization (WCO) issued the 2018 edition of the Guide to Customs Valuation and Transfer Pricing (“2018 Guide”). The 2018 Guide, the first-time update since WCO released the guide in June 2015, summarised the principles of customs valuation and transfer pricing, and also provided guidance on how to use transfer pricing documentations during customs valuation. 2018 Guide.The main revisions in 2018 Guide include the followings:
- Recent developments on transfer pricing at the Organisation for Economic Cooperation and Development (OECD), including the OECD/G20 Base Erosion and Profit Shifting (“BEPS”) Project;
- Recent case studies of the Technical Committee on Customs Valuation (“TCCV”); and
- Viewpoints and practices of Customs on the relationship between customs valuation and transfer pricing, with special additions / updates of those from Canada, South Korea and the United Kingdom.

Announcement of Shenzhen Customs on Relevant Matters concerning Customs Broker ([2018] No.9)
To further deepen the paperless reform of customs clearance and improve the level of trade facilitation, Shenzhen Customs issued an announcement on August 23, 2018, which further clarified matters related to customs declaration, including: the entrusted parties should sign an electronic power of attorney for customs clearance through http://www.chinaport.gov.cn. The declaration enterprise should fill the number of the electronic power of attorney for customs clearance in the documentation column attached to the customs declaration form.
Announcement of Wuhan Customs on the Pilot Paperless Reform of Customs Clearance of Inward and Outward Express Items ([2018] No.2)
In order to implement the requirements for the comprehensive integration of customs clearance and inspection services across China, further standardize the regulation of inward and outward express items in the customs area, and improve the facilitation level of customs clearance for inward and outward express items. On August 23, 2018, Wuhan Customs announced to carry out pilot paperless reform of customs clearance of inward and outward express items. For the customs declaration forms of Class A, B and C applicable to the new express items system as specified in Announcement [2016] No.19 of the General Administration of Customs, the express delivery operator shall upload the attached documents to declaration form through “Wuhan Customs Logistics Auxiliary Management System (Express Items)”. The announcement shall take effect on September 1, 2018.
