Indian revenue authorities are known to conduct very aggressive transfer pricing audits leading to major transfer pricing litigations. The Indian government has introduced a number of dispute resolution mechanisms to reduce transfer pricing litigation and to provide much needed certainty to foreign investors.
One of the key dispute resolution mechanisms has been the introduction of the Advanced Pricing Agreement (APA) program. Over the last few years, there have been a large number of APAs concluded. This has encouraged many more taxpayers/multinational corporations to opt for an APA route vis-a-vis the traditional transfer pricing audit route. In this regard, the Indian government has also recently released a report highlighting the success of the APA program towards creating a tax friendly environment.
