Document: Decree of the President of the Republic of Azerbaijan on the approval of the Rules on registration of food chain objects and food chain subjects, as well as objects that carry out production and processing of materials and products in contact with food products, approval of food chain objects, recognition of the equivalence of the approval system of foreign countries and conducting Food Safety Register ("Rules") and the "List of food chain objects approved by assessing compliance with the requirements of technical normative legal acts in the field of food safety (“Decree”).

Commentary: According to the Rules, a Food subject should apply to the Food Safety Agency of the Republic of Azerbaijan (“Agency”) for registering i) the place where the activity is carried out in the food chain (“food objects”) in which the preliminary production, production, processing, circulation, and disposal of food and feed products are carried out, ii) natural or legal persons, municipalities, state bodies engaged in activities in the food chain (“food subjects") operating without food objects, iii) as well as objects for the production and processing of materials and products in contact with food products.
In addition, the "List of food chain objects approved by assessing compliance with the requirements of technical normative legal acts in the field of food safety" ("List") has been approved by the Decree. A special procedure for the approval of food chain objects specified in that List is defined.
The approval procedure of food objects operating in foreign countries, as well as recognition of the equivalence of the approval system for foreign food establishments, is also provided in the Rules.
When food and feed products mentioned in the List are imported into the Republic of Azerbaijan, foreign food subjects or their authorized representatives, branches, or representative offices in the Republic of Azerbaijan should apply to the Agency for the registration of food objects operating in foreign countries where those products are produced and processed.
Re-approval of foreign food objects is not required if there is relevant official information on the approval of foreign food objects by the competent institution of the country whose equivalence of the approval system is recognized in Azerbaijan, or if relevant supporting documents are submitted to the Agency by those facilities.
Potential impact of the Decree: With the adoption of the Rules, a unified legal framework for the registration of food objects and subjects has been established which will bring clarity for registration procedure. Moreover, the approval of food objects operating in foreign countries and the recognition of the equivalence of the approval system for foreign food facilities defined in the Regulations will simplify the procedure for importing food and feed products into the country from abroad.
The Decree entered into force on December 30, 2023.

Bundan əlavə, Fərman ilə “Qida təhlükəsizliyi sahəsində texniki normativ hüquqi aktların tələblərinə uyğunluğu qiymətləndirilməklə təsdiq olunan qida zənciri obyektlərinin Siyahısı” (“Siyahı”) təsdiq olunmuşdur. Həmin Siyahıda göstərilən qida zənciri obyektlərinin təsdiqi üçün xüsusi prosedur müəyyən olunmuşdur.
Qaydalarda xarici ölkələrdə fəaliyyət göstərən qida obyektlərinin təsdiqi, həmçinin xarici qida obyektləri üzrə təsdiq sisteminin ekvivalentliyinin tanınması proseduru da öz əksini tapmışdır.
Siyahıda nəzərdə tutulan qida və yem məhsulları Azərbaycan Respublikasına idxal olunarkən həmin məhsulların istehsal və emal edildiyi xarici ölkələrdə fəaliyyət göstərən qida obyektlərinin qeydiyyatı üçün xarici qida subyektləri və ya onların Azərbaycan Respublikasında səlahiyyətli nümayəndələri, filialları və ya nümayəndəlikləri Agentliyə müraciət etməlidir.
Təsdiq sisteminin ekvivalentliyi tanınan ölkənin səlahiyyətli qurumu tərəfindən xarici qida obyektlərinin təsdiqinə dair müvafiq rəsmi məlumatlar olduğu və ya həmin obyektlər tərəfindən bu barədə Agentliyə müvafiq təsdiqedici sənədlər təqdim edildiyi halda onların yenidən təsdiqi tələb olunmur.
Fərmanın mümkün təsirləri. Qaydaların qəbul olunması ilə qida obyektlərinin və subyektlərinin qeydiyyatı üzrə vahid hüquqi baza formalaşmışdır. Həmçinin, Qaydalarda müəyyən olunmuş xarici ölkələrdə fəaliyyət göstərən qida obyektlərinin təsdiqi və xarici qida obyektləri üzrə təsdiq sisteminin ekvivalentliyinin tanınması ölkəyə qida və yem məhsullarının xaricdən idxal olunması prosedurunu sadələşdirəcək.
